The terms and conditions below apply to all contracts that a consumer enters into with Topbrands. When you place an order with us, you agree to the terms and conditions that apply to us at the time you place your order. Make sure that you have read and understood the applicable terms and conditions before placing your order. We reserve the right to change terms from time to time without further notice.
These terms of sale and delivery apply to the purchase of goods on www.benedikteutzon.com and for delivery in Denmark, with the help of Greenland and the Faroe Islands, unless otherwise expressly agreed.
Ordering and payment
www.benedikteutzon,com is open 24 hours a day, and it is therefore almost always possible for you to shop with us. However, it may happen that we close the store due to maintenance. It will only be possible to make purchases when the store is open and available.
To complete a trade on www.benedikteutzon.com you must be over 18 years of age and in possession of a valid debit card that we accept. However, if you have not yet reached the age of 18, you can still shop with us if you have obtained your guardian's consent.
To place an order with us, you select the items you want to buy and add them to your shopping cart. You can continuously check and correct the contents of the shopping cart and check the price of the goods until the time you place your final order.
When you are ready to place the final order, click "til kassen", after which you must enter your name, address, e-mail, tel. no., form of payment and choose the mode of delivery.
All prices are daily prices and include VAT. If you are looking for a special item that is not available on the webshop, you are welcome to contact us at www.benedikteutzon.com and we will try to get the item home for you.
At www.benedikteutzon.com, we deliver your order free of charge and use GLS for delivery. On weekdays, we aim to keep the delivery time at 1-2 business days. However, in the case of public holidays and during sale, a little more days may pass. If you place your order before 11am on weekdays, we will endeavour to send it to you on the same day, which means you will already have the goods the following day.
Delivery with GLS
We deliver to a GLS Parcel Shop or a business address.
When you have your package delivered through GLS, it will be sent to a pickup location near where you live. You choose completely freely from more than 900 places in Denmark where you can pick up your package.
GLS will send you an email when the package is shipped from their central and is heading towards your parcel shop. This email says when you can pick up the package. If you have entered your mobile number when ordering, you will also receive a text message.
You will pick up the package with the text message sent or the package number provided to you and a valid photo id. You can pick up your package for up to 5 days after arrival. If the package is not picked up, it will be returned to Benedikte Utzon. Unclaimed packages will be charged a $39 shipping fee,-.

It is safe to trade credit cards and on www.benedikteutzon.com credit card information is transferred in encrypted form with Secure Sockets Layer (SSL), a high-security encryption technique. This means that your information is sent through. a secure connection so that your card information can only be read by NETS, and neither the webshop nor others have the opportunity to see this information. As a payment gateway, we use QuickPay, which is certified according to pci standard.
You can pay with Dankort, VISA/Dankort, VISA Electron, Mastercard, American Expres and MobilePay. All card transactions are completed by Quickpay. We will not withdraw the money for your order until it has been shipped from our warehouse.
We will withdraw your money as soon as the payment is registered with us. Usually it only takes a few minutes. Of course, we do not charge any extra fee.
Receipt for receipt of order and order confirmation
Once you have placed an order with us, you will receive a receipt for our receipt of this. From the moment you receive an order confirmation from us by email, a binding purchase agreement has been entered into.
100 days right of withdrawal
You have 100 days full right of return effective from the day you receive your item when you shop on www.benedikteutzon.com During this period you can inform us that you regret the purchase and then the item must be returned to us. The right of return applies only to goods in unused condition. As a consumer, you may only take the item into account, which means that you are only allowed to try out your purchase as you would in a physical store. After receiving an item, you may only handle it in such a way that you can determine the nature, characteristics, and way in which it works. If the item is used, we will only return part or none of the purchase price. Any impairment is paid for by you as a consumer. The value of the item is determined according to what we can get for it in a further sale.
The right of withdrawal is valid 100 days from the day you receive the item. If the right of return expires on a public holiday, Saturday, Constitution Day, Christmas Eve or New Year's Eve, this is extended until the next business day. In the case of several items that are made in a single order but delivered individually, or an item delivered in several lots, the right of return runs from the receipt of the last item/ lot.
If you wish to exercise the right of withdrawal, you must notify us within 100 days of the day on which you receive the item. That is, you cannot undo your purchase by inaction.

Upon return, make sure that the item is properly wrapped, as you are responsible for the item until we receive it. We therefore always encourage you to save the mail receipt as well as any track and trace number.
Return is free when you use the attached return shipping label from GLS. As your return item is to be resold, we ask that you return the item in original packaging with hanging marks etc.
Please return your item as soon as possible and no later than 100 days after you have notified you of withdrawal.
Note! We do not receive packages sent per C.O.D.
You must complete and attach the accompanying return note attached to all our shipments. If you have lost your return note, you can get a new one by writing to us on firstname.lastname@example.org
Once we have received the item and approved the return, we will transfer the purchase amount to your account as soon as possible.
To avoid illegal use of stolen credit cards, we only refund to the credit card with which the item was purchased. We reserve the right to withhold payment until we have received the returned item or have
received documentation that the item has been returned.
NOTE: If the value of the item has deteriorated, you may lose your purchase amount, in whole or in part. This can happen because:
- you have put the item into service,
- the item has been damaged while you have been responsible for it,
- you have handled the product in a different way than was necessary to determine the nature, characteristics of the product;
and the way it works.
- you have not followed the restrictions on the right of withdrawal resulting from sealing, product type, etc.
Your purchase of the terms of purchase, including the deficiency rules. This means that you have a 2-year warranty, which means that either depending on the specific situation, you can have a defective item repaired, exchanged, refunded or refused the price.
It is, of course, a requirement that this is a legitimate complaint and that the defect has not arisen as a result of improper use of the product, wear and tear or other harmful behaviour.
You must advertise within a "reasonable time" after discovering the defect in the item. Therefore, we recommend that you advertise as soon as possible, and no later than 2 months after the defect has been discovered.

When returning an item, please state in as much detail as possible what the problem with the item is.

In the in the interest of a legitimate complaint, we will refund reasonable freight costs
If the complaint is justified, we will of course refund the freight costs incurred at the time of return if these are considered reasonable. Otherwise, you will have to bear all the return costs yourself, including our shipping costs of DKK 39,-. As we only want happy customers, we encourage you to get in touch if there is a problem with an item you have purchased from us.
Remember that the item must always be sent in safe packaging and always make sure you get a receipt for shipment. You are responsible for the package/item until we receive it. We therefore encourage you to save mail receipt including information about freight costs as well as any track and trace number.

Choice of law and venue

Reservations on errors
We make reservations for inventory errors, misprints, price errors missing deliveries and sold-out items. In the event of an error, we reserve the right to cancel an order as soon as we have made you aware of it.
Benedikte Utzon is responsible for all the personal information you provide to us in a purchase. We use the information to assess, agree and complete the delivery, as well as to nurture the customer relationship that arises from it, pursue outstanding payments, fight fraud and abuse, and comply with legal regulations.

Benedikte Utzon complies with all legal guarantees and regulations if there are errors in the goods you have purchased from us. If you have a complaint regarding a manufacturing defect on an item that we have delivered, including damage caused during transport, please contact us as soon as possible and return the item to us.
Complaints and consumer protection
If you receive an defective or defective handled item, Benedikte Utzon in case of return shipping will bear all the transport costs. The Danish Sale of Goods Act, which protects your interests as a consumer, is of course also applicable when you shop with us.
Benedikte Utzon is not responsible for any damage to you, except in cases where our liability insurance covers and where it is assumed that the insurer approves that a payment may take place. In addition to these cases, liability is generally limited to the maximum amount that makes up the purchase price of the current item. Benedikte Utzon is never responsible for collateral damage.
As a result of force majeure, Benedikte Utzon ceases obligations. If the period is longer than 2 months, both you and Benedikte Utzon have the right to terminate the agreement without any debts to be paid to the offender in such a case. Force majeure covers, among other things, strikes, illness of staff, transport disruptions and import/export bans, whether this occurs with us or our suppliers.
We do not guarantee that the colors displayed on the webshop accurately represent the actual colors of the products, as the reproduction of the colors depends on the settings on your computer, tablet, etc.
